Regulation Overview
The General Product Safety Regulation is the EU's baseline product safety law, and GPSR compliance applies to any consumer product placed on the EU market that is not fully governed by stricter sector-specific safety rules. It replaced the 2001 General Product Safety Directive and became directly applicable, with no national transposition required.
The core duty is simple: only safe products may be placed on the market. A product may be placed on the EU market only if an economic operator established in the Union is responsible for it. That responsible person, defined in Article 16, operates through Article 4 of the Market Surveillance Regulation (EU) 2019/1020.
GPSR compliance rests on evidence: technical documentation, supplier test reports, and clear labelling. When authorities or an online marketplace ask for proof, the operator must produce it. Dangerous products are published on the Safety Gate Portal by name.

Manufacturers of consumer products placed on the EU market
Importers bringing consumer products into the EU
Distributors making consumer products available in the EU
EU-established responsible persons designated under Article 16
Providers of online marketplaces facilitating EU consumer sales
Non-EU sellers reaching EU consumers through distance sales
Key Thresholds
Non-EU sellers often discover Article 16 the hard way. A product cannot be placed on the EU market unless an EU-established operator is responsible for it, with contact details on the product, packaging, parcel, or accompanying document. Without automated supplier data collection and portals, assembling the evidence behind that role across a catalog is slow and incomplete.
An accident caused by your product must be reported through the Safety Business Gateway without undue delay from the moment you know of it. The facts you need sit in supplier files, test reports, and emails. Without a centralized compliance data backbone, you cannot confirm which product, which batch, and which evidence applies in time.
A market surveillance authority requests the technical documentation for a product. Article 9 requires a risk analysis and compliance file kept for ten years. Supplier test reports are in mixed formats, some expired, some missing. Without AI document parsing and certificate validation, proving the product is safe becomes a manual scramble.
The Safety Gate Portal publishes dangerous products by brand name, and marketplaces delist listings that cannot show compliance. One unresolved gap becomes public and commercial at once. Without continuous compliance monitoring and audit readiness, the first sign of a problem is a delisting notice or a border detention.

Frequently Asked Questions
Who needs an EU responsible person under the GPSR?
Any consumer product placed on the EU market needs an EU-established economic operator responsible for it under Article 16, operating through Article 4 of Regulation (EU) 2019/1020. For non-EU manufacturers this is usually an importer, distributor, or authorised representative. Certivo organizes the supporting evidence, but does not act as the responsible person.
Does the GPSR apply to CE-marked products?
The GPSR works as a safety net. Where sector-specific EU legislation governs a safety aspect of a product, that law applies; the GPSR covers consumer products and the general-safety aspects those sector rules do not address. A CE-marked product can still carry GPSR duties for risks its sector directive does not cover.
What must a GPSR product label show?
Labelling must allow the product to be identified and must show the responsible person's contact details, including a name and a postal or electronic address, on the product, its packaging, the parcel, or an accompanying document. For distance sales, the online offer must display this information before purchase.
What are the penalties for GPSR non-compliance?
Penalties are set by each EU member state under Article 44 and must be effective, proportionate, and dissuasive; the regulation sets no fixed amounts. In practice the first consequences are often commercial: marketplace delisting, border detention, forced recalls, and publication on the Safety Gate Portal. Certivo's continuous compliance monitoring helps keep evidence current.
How does Certivo support GPSR compliance?
CORA collects supplier test reports and safety data, validates documents through AI document parsing and certificate validation, and assembles technical documentation packs and responsible-person evidence per product. Human teams review and decide. Certivo supports GPSR compliance and audit readiness; it does not certify products or act as your EU responsible person.
